Development of all tasks related to the taking of evidence and decision of administrative offence’s processes in Cascais’ local authority, Department of Legal Affairs.
With close contact with all Town Hall’s Departments and Divisions and procedural defense in the local jurisdiction.
Professional Activity developed in Oliveira de Azeméis’ local authority
From 2005 to April 2009:
Carrying out of tasks with responsibilities in Urban Planning; Land Use Planning; Private Works; Parcelling; Advertisement (licensing procedure); legal aspects referring to Planning and Municipal Supervision, analysis and training in processes related to complaints and appeals in environmental and urban matters.
Tasks performed in Private Works and Land Use Planning:
1) Direct and permanent legal advice to the Town Council responsible for the private Works and Land Use Planning Division and Planning and Urban Planning and Environment’s Management Division. Study and analysis of all Division’s processes; information’s processing and decisions’ drafts to be presented to the Decision-maker.
The number of studied processes and informed ones was superior to 2.000/year.
2) Regular meetings with Town Council; Leadership of the Private Works and Land Use Planning’s Section; Leadership of Private Works and Land Use Planning Division and with DPGUA(Urban Planning and Environment) responsible in requests of clarification; information and suggestion of suitable and legal procedures;
3) Clarification and guidance to the Works’ Division Registry, namely: suggestions about organization, dynamics and procedural termination; guidance and information to be given to the public; information about certificates’ requests and processes copies and procedural organization in demolition’s processes, seizures and complaints;
4) Clarifications and guidance to the municipal surveyors – namely, in the drawing up of police reports; seizure reports and state takeover reports. Monitoring in the “field” to notify regarding state takeover and subsequent demolition works.
5) Clarifications regarding legal affairs of the Works’ Department;
6) Clarification’s meetings with the Technical Board of DOPL;
7) Clarifications in all activities of planning and urban planning management namely, in the design and change of the municipal technical legal regulation – Municipal Master Plan; Block Plans, among others, related to the Decree-law nr. 380/99 of 22/09 in its current legal drafting.
Tasks developed out of the scope of the Works’ Division
a) Legal advice to the Executive
Direct and permanent legal advice to the entire Executive.
Preparation of draft opinions; Information and suggestions to all areas (deliberations’ drafts and/or orders; information about legal framing of diverse situations).
b) Participation in the drawing up of regulations, municipal codes, rules and internal executive orders
1) Regulation of Municipal Market;
2) Municipal Regulation of Itinerant Trade;
3) Municipal Regulation of Urban Building (RMEU);
4) Regulation of fees and licenses under Decree-law 555/99 of 16/12;
5) Regulation of the Joint Committee for the Coordination of Municipal Master Plan for the Land Use Plan.
c) Municipal Police
Guidance for assignment as booking authority to the Town Hall of Oliveira de Azeméis by DGV.
d) Human Resources
Taking of evidence and decision in detailed investigations and disciplinary proceedings.
Direct and permanent legal advice to the Town Hall Council about all tasks involving human resources.
Participation and recruitment of the town hall staff.
Drawing up of information and proposals to establish and change proceedings.
e) Support to the Section of Contracts and Notaries
Drawing up of Protocols’ models; of Associations and Contracts’ constitution.
The legal support to the Section was done by verbal information/guidance and by support in the drawing up of acts to be done by the latest.
Other tasks
· Participation in the Selection Board of proposals in open request for tenders, as well as in Commissions for analysis of proposals and drawing up of respective models;
· Participation in the Selection Board of the external tender to the admission and evaluation of advanced technicians in Law. Drawing up of written exams and oral exams;
· Participation in the Selection Board to the analysis of proposals to City’s block plan;
· Participation in multidisciplinary Teams to the alienation of local authority’s assets;
· In partnership with the Assets’ Section: survey; taking of evidence and investigation of complaints presented by citizens, in order to establish the responsibilities of the local authority in contingent damages;
· Legal monitoring to the Water and Sanitation’s Division (DAS);
· Drawing up of information about equipment to be purchased.
Education
October 1989 to 11th July 1994 – Law degree (legal arm) by the Portucalense Infante D. Henrique University, in Porto.
October 1994 to December 1996 – Admission in the Portuguese Lawyer’s Association. With honour.
